Our community forms the bedrock of our operations; without your participation, we wouldn’t be here. Thus, we place our trust in the integrity of individuals to uphold positive conduct, treating one another and their belongings with honor, consideration, and empathy. These principles we all share not only foster an inclusive atmosphere for every community member but also transcend factors such as appearance, affection, beliefs, self-identity, origin, or birthdate. In alignment with these core values, we unequivocally reject all forms of discrimination within the KodaCars community.
The Policy Against Discrimination covers aspects such as race, color, ethnicity, religion, age, national origin, residence or geographic location, ancestry, sexual orientation, gender, military service, disability, gender identity, and marital or parental status.
KodaCars Policy Against Discrimination:
Members of the KodaCars community are strictly prohibited from engaging in any actions that suggest or encourage bias against any guest based on their race, color, ethnicity, religion, age, national origin, place of residence or origin, ancestry, sexual orientation, gender, military service, disability, gender identity, or marital/parental status.
Specifically, KodaCars hosts are not allowed to:
1. Decline or cancel reservations based on race, color, ethnicity, religion, age, national origin, place of residence or origin, ancestry, sexual orientation, gender, military service, disability, gender identity, or marital/parental status.
2. Apply distinct terms or conditions based on race, color, ethnicity, religion, age, national origin, place of residence or origin, ancestry, sexual orientation, gender, military service, disability, gender identity, or marital/parental status.
3. Create listings that exhibit bias or preferences for or against any guest based on race, color, ethnicity, religion, age, national origin, place of residence or origin, ancestry, sexual orientation, gender, military service, disability, gender identity, or marital/parental status.
KodaCars Non-Discrimination Policy ensures a fair and inclusive environment for all members of the community, promoting respect and equal treatment without regard to these protected characteristics.
Gender identity:
KodaCars hosts may contact customer support if the gender presentation of a guest does not appear to match their license.
Non-Discrimination Policy – Disability:
KodaCars Hosts are required to adhere to the following guidelines concerning guests with disabilities:
Prohibited Actions:
Hosts are not allowed to make assumptions about a guest’s ability to operate their vehicle.
Declining or canceling a trip based on the actual or perceived disability of a guest is not permissible.
Inquiring about the presence or severity of a guest’s disability, or the methods they employ to accommodate it, is not allowed. If a potential guest discloses their disability, the host should engage in a discussion regarding whether their vehicle meets the guest’s needs.
Posting listings or making statements that discourage or demonstrate a preference against guests with disabilities is strictly prohibited.
Refusing to communicate with a guest who has a hearing disability using their preferred mode of communication is not allowed.
Allowed Actions:
Hosts may provide factual information about the accessibility features of their listing, such as whether the vehicle has automatic doors, lack of storage space for a wheelchair, or an inaccessible parking location.
Policy on Non-Discrimination Regarding Familial Status:
Familial status is an important consideration when interacting with KodaCars platform, and hosts are required to adhere to the following guidelines:
Hosts are prohibited from taking actions such as declining, canceling, or applying different terms or conditions to a reservation based on familial status. This includes situations involving having a child under the age of eighteen, being pregnant, or undergoing adoption or custody proceedings.
However, hosts are allowed to provide accurate information about specific features (or the absence thereof) within their listing that could potentially impact the safety or suitability of the rental for families with children or infants.
In scenarios where a guest’s family needs cannot be met due to circumstances beyond both the guest and host’s control, it is recommended that hosts contact customer support for assistance. For example, if a guest arrives to collect a vehicle with a child who requires a car seat, but one is not available, proper communication with customer support is advised.
This non-discrimination policy aims to ensure that all guests, regardless of familial status, are treated fairly and equitably while using the KodaCars platform.
Guidelines on Non-Discrimination:
KodaCars approach to non-discrimination emphasizes personal preferences and the well-being of all parties involved. KodaCars hosts retain the right to decline or cancel reservations based on various factors, while maintaining a respectful and inclusive environment. These factors, however, must exclude considerations such as race, color, ethnicity, religion, age, national origin, residence or geographic location, ancestry, sexual orientation, gender, military service, disability, gender identity, or marital/parental status, as indicated above.
For instance, a host has the prerogative to refuse a guest who intends to use the vehicle for specific purposes like towing a boat or filming a commercial, demonstrating that non-discrimination is not intended to infringe upon reasonable and responsible limitations.
Important Notice for New York Residents:
It’s essential to recognize that New York State Law enforces strong non-discrimination practices for peer-to-peer car sharing program administrators. These practices ensure fairness and inclusivity by prohibiting discrimination based on attributes like race, color, ethnic origin, religion, disability, sex, marital status, residence or geographic location, income, sexual orientation, genetic predisposition, or age. Specifically, these prohibitions extend to (1) the refusal to allow participation in a peer-to-peer car sharing program and (2) the imposition of any additional charges, except in specific instances where the shared vehicle driver is under the age of 25.
Moreover, New York law also mandates that participation in such programs should not be denied based solely on the requirement of owning a credit card. This comprehensive approach safeguards against discrimination and ensures equitable access to peer-to-peer car sharing services for all individuals in New York.
Non-Discrimination Policy in Countries Outside the United States and European Union:
For KodaCars hosts operating in countries outside the United States and the European Union, compliance with the above-stated policies is not mandatory if doing so would contravene local laws.
Actions Following Non-Compliance with the Non-Discrimination Policy:
Instances of discrimination within the KodaCars community will be assessed individually, with KodaCars examining each case on its merits. Appropriate consequences will be applied to community members who breach our non-discrimination policies. These consequences may encompass actions such as removal from the KodaCars marketplace, among others.
Ongoing Commitment to Inclusivity:
As the KodaCars community expands, our commitment to fostering an inclusive and respectful environment remains steadfast. We will persist in refining our policies to ensure that all interactions among KodaCars community members are characterized by a sense of welcome and respect.
